Research project PC/20 (Research action PC)
This research concerns the basic level of legal protection of citizens in their relations with administrations. The research focuses both on how the "administered citizen" is associated with the process of reaching the administrative decision and on the procedures used to present the decision to him/her, to explain it, in a perspective of sound administration and prevention of litigation.
The study includes three sub-studies. The focus is on three aspects of the same legal communication problem:
- legality and appropriateness of the decision's justification, mediation prior to judicial action;
- a comparative study of the law pertaining to the application of foreign regulatory texts deemed particularly significant;
- efficiency and organisation of the inclusion of the citizen in the decision process in procedures of consultation and inquiry; a useful example of dysfunctioning is given.
The objective is to produce a synthesis that can be used to establish structured, effective rules for non-contentious administration.
